Issues of Contract Formation in Internet Contracting: When Electronically Mailed Acceptance Ought to be Effective

Contract formation is not a settled issue despite the fact that internet medium has been used for contracting for more than a decade. Scholars are not in agreement about the results yielded by the application of the existing laws to internet environment, while policy framework and additional regulations have been laid out from time to time with the belief that they facilitate favourable legal environment towards the increased uptake of electronic commerce. This paper aspires to analyse policy consideration with regard to acceptance made via electronic mail. The paper argues that given the features of the medium, the dispatch theory, on balance, is a more desirable theory to govern the communication of acceptance via electronic mail.
